Business Owners’ Responsibilities Under the OHS Act: Ensure Compliance with SHEQ4SME Safety Files

 The South African Occupational Health and Safety Act (OHS Act 85 of 1993) places significant responsibilities on business owners to ensure a safe and healthy workplace. What Does the OHS Act Say About Business Owners’ Responsibilities?

The OHS Act mandates that employers, including business owners or Chief Executive Officers (CEOs) under Section 16(1), must ensure a workplace that is safe and without risk to the health of employees and others affected by their operations, as far as is reasonably practicable. This includes:


  • Maintaining a Safe Work Environment: Provide and maintain systems, equipment, and premises free from hazards (Section 8). This includes regular risk assessments to identify and mitigate risks like machinery hazards or chemical exposures.


  • Providing Training and Information: Ensure employees receive adequate training, instructions, and supervision to perform their work safely (Section 13). This includes guidance on using personal protective equipment (PPE) and handling hazardous substances.


  • Appointing Health and Safety Representatives: For businesses with more than 20 employees, designate health and safety representatives in writing within four months of commencing operations. Establish health and safety committees to promote and review safety measures (Section 17–19).


  • Reporting Incidents: Notify the Department of Labour of any incident resulting in death, serious injury, unconsciousness, or amputation within seven days, and immediately for severe cases (Section 24). Failure to report is an offence.


  • Developing Safety Policies: Create a health and safety policy statement, outlining how safety measures will be implemented and reviewed, as directed by the chief inspector (Section 7).


  • Supervision and Compliance: Appoint competent supervisors to enforce safety protocols and ensure compliance with the OHS Act across all operations.

Where Does the Business Owner’s Responsibility End?

  • Employee Negligence: Employees must also take reasonable care for their own safety and follow safety protocols (Section 14). If an employee recklessly ignores a provided safety manual or misuses equipment, they may share liability.
  • Delegation to Competent Persons: Under Section 16(2), CEOs can assign duties to competent appointees (e.g., health and safety supervisors), who act under their direction. However, the CEO remains ultimately accountable unless the appointee’s negligence is proven.
